📖 Under Art. 3(1) AI Act, an AI system is a machine-based system that operates with some degree of autonomy and infers outputs (predictions, decisions, content, recommendations) influencing real or virtual environments. Traditional deterministic software generally falls outside this definition.

Does your GPAI model have systemic risk?

A GPAI model is presumed to have systemic risk if it was trained using more than 10²⁵ FLOPs or if the European Commission designates it as such (Art. 51). This triggers additional obligations.

💡 If systemic risk is uncertain, it is recommended to treat the model as if it has systemic risk to ensure compliance. The AI Office may also designate GPAI models as systemic risk.

⚠️ Even if your system falls in one of these domains, it may not be high-risk if it only performs a narrow procedural task, improves a previously completed human activity, or is purely preparatory (Art. 6(3)). However, profiling of individuals always qualifies as high-risk.
